Arushi Murder case.
In fact to summarize the case of Arushi murder it was the TV media which murdered the case. Because of this CBI failed to investigate in right perspective. It is just like Hemant karkare’s murder by Pakistani terrorists because the TV media were for no reason covered every activity of him and that helped the terrorists to get clue as to what is he doing during managing the affairs and terrorist with such activities managed their aim.
In Arushi murder case unwanted importance was given by TV media for best known reason and it owned responsibility as if it is an investigating agency. It not only ‘investigated’ the case but also made ‘inquiry’ and ‘trial’ too. It decided the case also This was called judicial activism by media. Such type of behavior by TV media one can conveniently doubt about its integrity
I had commented on the statement by the then Chief Justice of India Bal Krishnan that because of the media it became difficult to decide cases and in particular bail application. He was speaking in Hyderabad. This means for the courts in India the arguments by advocates on bail application, the case law and facts of the cases had no meaning and it was the report of the media which used to prevail over the mind of the judges to dispose of the cases!! His bad habit was he frequently meat media and got reduced his importance and image. It is a saying in India since 5th century that too much familiarity breads contempt.
True it is that the CBI has submitted Closing report that is Expunging Report (ER) to the court but this does not mean that the case is finally closed for ever. This only means that presently he police has stopped investigation but not for ever. When any clue is traced the CBI will again sick permission and reopen the case. Before the closing report is accepted by the court the court will as per the law summon the complainant Rajesh Talwar the father of the deceased to say what he has to say. After hearing the CBI and the victim’s father the court may either pass an order for closing the case for time being or the court may after examining the case diary direct under Sec. 156 of the Code of Criminal Procedure to investigate the case on directions to be issued by monitoring the case by the court.
The father Rajesh Talwar has also a right to file a private complaint against known or unknown persons as the case may be as per sec. 2 (d) read with Sec. 200 of the said Code.
However the dramatic and instigating attitude of the TV channels has lost their reliability. We as a rule give hundred percent discounts on correctness of the news in substance.
